FMC seeks comments on detention and demurrage petition

The U.S. maritime regulator said it is inviting comments no later than Feb. 28 on the petition that was filed by the Coalition for Fair Port Practices earlier this month.    The Federal Maritime Commission (FMC) is seeking comments on a petition that was filed earlier this month that asks the agency to initiate a rulemaking to clarify what constitutes just and reasonable rules and practices in regards to the assessment of demurrage, detention and per diem charges by ocean common carriers and marine terminal operators when ports are congested or not accessible.
   The petition was filed by the Coalition for Fair Port Practices, a group of 25 members that represents shippers, receivers, motor carriers, port draymen, freight forwarders, third-party logistics companies and customs brokers.
   The Coalition for Fair Port Practices wants the FMC to issue a statement of policy that says if an ocean carrier or terminal is unable to deliver or receive equipment – for example, because of weather, port congestion/disruption or government action – then it is unreasonable not to extend free time.
   The FMC is inviting comments on the petition no later than Feb. 28.
