The agency has proposed civil penalties ranging from $54,000 to $63,000 against the companies.
Buschar Racing is being penalized for offering 10 10-ounce cans of flammable aerosol spray to UPS for shipment from Milan, Ohio to Quebec last year. The FAA said the shipment was not accompanied by papers describing the type or quantity of hazmat and was not properly marked or labeled, and the employee who prepared the shipment did not receive required hazmat training.
Sherwin Williams was hit with a $63,000 penalty for shipping cans of flammable paint aboard a FedEx flight from Piqua, Ohio, to Niagara Falls, N.Y. FedEx employees at the company’s sorting facility in Indianapolis discovered that the shipment was leaking.
In June, the FAA levied a $71,500 fine against the paint manufacturer and retailer for knowingly tendering undeclared hazardous material to FedEx.
Rock Water Energy Solutions allegedly shipped aerosol paint in checked baggage aboard an Envoy Airlines passenger flight from Denver to Midland, Texas. The spray cans released paint in the cargo hold.
X-Chem LLC of Irving, Texas, allegedly shipped bottles of flammable liquid and a bottle of corrosive material via FedEx.
Companies have 30 days to respond to the penalty notices.
