ITC investigates Nintendo Wii imports

   The U.S. International Trade Commission has voted to investigate imports of certain video games and controllers, namely Nintendo’s Wii system.

   The investigation is based on a complaint filed by Motiva of Dublin, Ohio, on Oct. 1. The complaint alleges that certain sales of imported video games and controllers infringe on Motiva’s patents asserted. The complainant requests the ITC issue an exclusion order and a cease-and-desist order.

   The ITC’s chief administrative law judge will assign the case to one of the agency’s six administrative law judges, who will schedule and hold an evidentiary hearing. The judge will make an initial determination as to whether there is a violation.

   In the next 45 days after starting the investigation, the ITC will set a target date for completing its investigation.
