After a notice Tuesday by the Federal Motor Carrier Safety Administration that it is revoking an electronic logging device — TMS ONE’s ELD ONE — from its list of self-certified ELDs, CEO Radu Murzac says the company is working on a fix and plans to have the “final issue” resolved in less than two weeks.

“When we first came to market, the process to become an ELD provider was relatively new,” Murzac told FreightWaves. “We navigated this process with the best interpretation of the law as we could. However, we’ve come to learn that the interpretation and logic we based a few components of our platform on was not in full compliance of the mandate.”

FMCSA did not respond to FreightWaves’ request seeking comment.

Over the past few months, Murzac said, his company has been meeting with representatives from FMCSA and “diligently working to address their concerns.”

“Unfortunately, we fell short,” he said. “In working on the original issues, new issues came to light.”

Two weeks prior to FMCSA revoking ELD ONE from its list of self-certified ELD providers, the company alerted customers about problems with its platform, according to an email sent by the ELD ONE team on Jan. 11, which was obtained by FreightWaves.

“In the previous months, we’ve been working with FMCSA on several deficiencies within our system. We’re subject to the same laws and regulations as all other ELD providers and hope you understand that we are making these changes in an effort to help our clients stay compliant with the ELD mandate,” the email stated.

The company outlined two key deficiencies identified by FMCSA.

“The first is that per ELD regulation, automatically recorded Drive segments cannot be edited,” the email stated. “Effective 01/11/2023, the ability to edit automatically recorded drive time will be eliminated. We have recognized that there are times when the driver makes an error — such as forgetting to put himself in PC [personal conveyance] or shutting down the system improperly that will result in erroneously recorded drive time. We are working on a solution to this and hope to have this feature released by the end of this month.”

ELD ONE stated that the second functional change “is that logbook software (often referred to as ELog) should not exist in the same platform as ELD.”

“In fact, if you have an ELD installed you are required to operate that as an ELD even if you are not subject to the mandate. As every device we sell is an ELD, we are required to shut off the ELog functionality of the platform.”

Murzac said more than 10,000 users may be affected by the revocation. He said the company will have a platform “in full compliance with the law.”

Meanwhile, FMCSA is advising motor carriers and drivers to do the following:

  • Discontinue using the revoked device(s) and revert to paper logs or logging software to record required hours-of-service data.

Motor carriers using ELD ONE devices have up to 60 days to replace them with compliant ELDs. However, if ELD ONE corrects the identified deficiencies, FMCSA will place the device back on the list of registered devices, according to the agency’s notice.

Truck drivers who continue to use the revoked device on or after April 1 will be placed out of service in accordance with the Commercial Vehicle Safety Alliance OOS Criteria.

More than 860 ELD providers have self-certified their devices with FMCSA since February 2016. Of that number, ELD providers have self-revoked 79 devices from the registry. 

Besides ELD ONE, headquartered in Elgin, Illinois, FMCSA has only revoked two other ELDs, including Arion Tech Inc. of Mississauga, Ontario, in June and ELDorado of Miami in September.

Murzac said ELD ONE welcomes FMCSA’s assistance as it works to resolve issues to ensure truck drivers are “adhering to the law.”

“There are plenty of less-than-ethical providers in the market and we hope that with this new emphasis and level of enforcement we will see a fair marketplace, one that meets the needs of our valuable drivers and keeps them on the road moving America forward,” Murzac said.

    So driver came to me from OTR because he was tired of running 100 hrs weeks. I did not believe it was possible on ELD. He showed me his ELD on his phone (EZLOGZ). He was something like 40 hrs ON DUTY (he intentionally did not signed off). All red. As soon as he went OFF DUTY, his logs went to grey (not verified, but legal), last few days edited themselves.
    I asked if I can get this type of service (hypothetically), he said, no, it is “special” subscription only.

    With limited knowledge of the situation, I can see how you may draw that conclusion. However, there are situations that do allow for editing of automatically recorded drive time. Furthermore our system is unlike the other ones mentioned, that hide the edits, our system shows each and every edit. The problem we encountered was related to the idea that as drivers would make a mistake the mistake could be corrected with an annotation. We never hid the edit and required an annotation of the edit and always displayed the history of such. We are meeting with the FMCSA regularly and are expecting to get the ELD ONE back on the approved list. Thank you.

They have office in europe handling everythin you call a number give your password, and you get hours you need to finish the load. You drive as much as you want. If someone tells you different they are lieing. EZ LOGZ, ELD RIDER, MASTER ELD, A1 ELD or all in one ELD, there is so many.This is competiton to Radu! These guys will sell you trucks and trailres next to eld. They say, with our system you can make money with truck bc you are in charge of how much it makes-like car salesman. If only those conversations were recorded and if freightwaves played this HAHA. imagine foreign accent like in movies and everything is possible,illegal eld, no probem, truck, no problem, remove def from truck, no problem,need trailer, no problem,need fuel card, no problem.I forget you can also get tires. And also say they can find drivers if you buy a truck from them and then lease it back to them and make big money. Forgot to mention they like all have trucking companies and grow them by stealing drivers from people not cheating. drivers make 2x more and nothing will keep them. nothing.     The eld mandate had nothing to do with safety and everything to do with money. If the FMCSA cared anything about safety, they’d require better training for who is driving these trucks. The elog forces you to conform. I’ve driven tired much more on an elog than I did on paper. We’re always in a hurry and are forced to stop when we could safely keep driving. Like every other bloated government agency, the FMCSA has people that have never even driven a truck, making rules for those of us that do. They do it under the guise of safety. They’ll promise the public that there will be safer roads and less fatigued drivers and when their mandate falls short on providing the safety that they promised, they’ll double down and say that there’s more that needs to be done. It’s gonna be a never-ending cycle. There’ll be more and more regulations until there’s no one but mega carriers left to haul the freight and a bunch or useless idiots to drive. Fatal crashes will continue to rise and they’ll keep piling on the regs to “combat” it. The government is never the solution but always the problem.

    This is professional gaslighting by the CEO of ELD ONE. Non-editable drive time would be one of the basic minimum requirements of any conforming ELD. That is intentional deception.

It’s not about safety.” right on the money. there is a company out of chicago claiming to have people on payroll at DOT and this is why they can offer fraduelnt eld. look up ELD RIDER. look up rocky caylor is the name I believe they said was their protector at DOT.he wanted to be mayor of naperville in illinois but opposition destroyed him so he went back into his hole. if anyone has more information please share w/everyone. i will ask my peers for more names as i know there are more i cant rememebr now.

    The FMCSA is a joke, so is their mandate. Companies like ELD ONE and a lot of other ELD companies offered monitoring services for a fee with their platform. This group would monitor drivers logs in realtime for out of service violations. The company would contact you by theTelegram app to inform you of the upcoming violation. If you had a violation you could have your logbook edited for a monthly fee. There are numerous people out there doing this. It is un-detectable. The FMCSA pathetic mandate does nothing. If you wanted to bypass this mandate, what would stop a so called driver rom having 2 or more ELD devices in their truck, with 2 or more paid subscriptions on those devices, with 2 or more user names and alakazam, you have as many logs as you need. All you do is sign out of one device, sign into the other device, fill out a blank bill of lading for the starting point and I can pass any inspection in any state. Until the FMCSA gets some real drivers who like have 30 years under their belts to help them do this they will forever be in the dark. The ATA, it’s affiliated company’s and drivers are not who you ask. If your truck doesn’t have a sleeper and you go home every night, this is you. It takes a cheater to catch a cheater. The FMCSA could care less about your safety. What they want is your money. This mandate is laughable at best. What I would like to see is a list of government connected employees and lawmakers who have a vested interest in this technology. Follow the money. It’s not about safety.
